NDAA Section 842 Compliance

NDAA Compliance for a More Secure Tomorrow

U.S.-Manufactured Lithium-Ion Battery Solutions – Built for Today. Ready for 2027.

The National Defense Authorization Act (NDAA) restricts certain foreign-made components and technology – including batteries – from use in defense and many federal government applications. American Lithium Energy (ALE) manufactures cells and packs in the USA with U.S.-sourced electrolytes and electrodes, meeting Section 842 and FY2020 requirements with January 2027 readiness.

What Is the NDAA?

Protecting the U.S. supply chain

The National Defense Authorization Act (NDAA) establishes requirements to protect the U.S. supply chain by restricting certain foreign-made components and technology from use in defense and many federal government applications.

For batteries, Section 842 restricts certain foreign-sourced cells and packs for Department of Defense and federal use – and the requirements are expanding. OEMs building for defense, federal and critical infrastructure programs need a battery supply they can document from cell to pack.

Key Timeline

  1. Section 842

Restrictions on certain foreign-sourced batteries for DoD and federal use.

  2. FY2020

    Initial requirements begin phasing in.

  3. Next milestone January 2027

Expanded requirements take effect for additional covered applications.

Why It Matters

More than a compliance checkbox

National Security

Reduces dependence on foreign-controlled supply chains.

Supply Chain Resilience

Supports reliable, trusted U.S. sources.

Access to Opportunity

Required for many defense, federal and critical infrastructure programs.

What It Means for OEMs

What NDAA compliance asks of your program

If your products serve defense, federal or critical infrastructure customers, the battery inside them is now part of the compliance conversation.

Compliance Requirements

Verify battery cells and packs meet NDAA requirements.

Documentation

Maintain traceability and supporting documentation.

Risk Mitigation

Avoid program delays, re-designs or loss of federal business.

Competitive Advantage

Position your products for current and future federal opportunities.

How this reduces program risk

Shorten the supplier qualification path and remove the most common reasons a battery vendor is disqualified late in the program cycle.

  • One supplier accountable for the entire energy storage subsystem – no integration mismatch between cell, pack and BMS vendors.
  • No foreign cell qualification. NDAA Section 842 compliance is built in from raw material sourcing forward.
  • Documentation packages designed for U.S. defense acquisition workflows.
  • Engineering samples available before production tooling is committed.
  • Direct technical exchange with ALE engineering at every stage, from concept through sustainment.

Common Questions

NDAA battery compliance FAQ

Does the NDAA ban all foreign batteries?

No. It restricts certain foreign-sourced batteries for specific federal and defense use.

When do the new requirements take effect?

Expanded requirements take effect in January 2027.

What documentation is needed?

Compliance certifications, test data and supply chain traceability.

Are all ALE batteries NDAA compliant?

Yes. ALE manufactures cells and packs in the USA with U.S.-sourced materials.

Which applications are affected?

Defense, federal government and many critical infrastructure and regulated markets.
